Assistant District Attorney Andrew Maier and defense attorney Mary Lou Robinson will make their final pitches to the jury that will decide whether Ashauer being under the influence (his BAC was .195) was a major contributing factor to the crash. Mary Lou Robinson must prove in her affirmative defense that the crash was unavoidable. Her duty was two-fold in this case: prove the affirmative defense and cast doubt on the State's theory.
It should be interesting. I am speculating the jury will be out for a while. This isn't an easy case, at least not in my eyes, when looking at all of the testimony. But, I could be wrong. You never know what a jury is going to do. Waiting for a jury to come back is like waiting for a baby born: it could take five minutes, five hours or five days. You just never know.
